In a short decision, the District Court granted a motion to compel arbitration of a dispute for the recovery for damages due to Hurricane Ida. Having noted the liberal federal policy favoring enforcement of arbitration provisions, especially regarding international commerce, the Court found that the four requirements for compelling arbitration under the New York Convention were met: there was a written agreement to arbitrate; the agreement provided for arbitration in a Convention signatory (here, the United States); the agreement arose out of a commercial legal relationship (an insurance policy); and a party to the agreement (Certain Underwriters) was not a US citizen.
