The Court granted the motion for default judgment confirming two French awards, rendered in 2017 and 2020, respectively, finding that no grounds for refusal under the New York Convention had been raised or were apparent. The Court considered that although A.D. Trade had failed to file a confirmation petition within three years after the 2017 award was made, as required under Sect. 207 of the Federal Arbitration Act, which implements the Convention in the United States, Guinea, as an absent defendant, forfeited a statute-of-limitations defense, and the Court could not raise it on its own initiative.
