United States Court of Appeals, Fifth Circuit, 29 January 2024, No. 22-30808
(Conti 11. Container Schiffarts-GmbH & Co. KG M.S., MSC FLAMINIA v. MSC Mediterranean Shipping Company S.A.)
UNITED STATES 29 January 2024 Conti 11
The Court of Appeals reversed and remanded the decision of the district court, which had confirmed an award rendered in London. The Court found that the court had lacked personal jurisdiction over MSC.
The court discusses the principle that the procedure for the enforcement of awards under the Convention is governed by the lex fori, as well as procedural issues (such as the competent enforcement court) not falling under the specific cases of ¶¶ 302-307.
