Summary

The Court of Appeal held that India’s ratification of the New York Convention is not a submission to the jurisdiction of the English courts. The Court applied the holding of the Supreme Court in Spain v. Infrastructure Services, which found that Article III of the Convention preserves domestic “rules of procedure”, and that state immunity forms part of these rules.
