SINGAPORE 2026-4
Singapore International Commercial Court of the Republic of Singapore, 25 June 2025
(Cooperativa Muratori and Cementisti – CMC di Ravenna v. Department of Water Supply & Sewerage Management, Kathmandu et al.)
SINGAPORE 2026-4
The parties’ contract contained an SIAC arbitration clause designating Singapore as the “place of arbitration”. Noting that references to the “place” of arbitration are usually construed as designating the seat, the Court granted an interim anti-suit injunction restraining the second defendant from pursuing proceedings in Nepal to set aside that arbitral decision.
Related court proceedings: The court discusses measures in aid of arbitration (e.g., anti-suit injunction). This topic also includes the issue of the relationship between the Convention and the recognition of a foreign judgment on the validity of the arbitration agreement.
