The Court (SINGAPORE 2026-2) granted a stay of proceedings for the enforcement of a Swiss award, based on the SCC arbitration agreement in the settlement deed entered into by the parties following the award’s rendition, by which they agreed to stay all present and future proceedings relating to the award provided that the present defendant and another party were not in breach of their obligations under the deed. By the present decision, the Court granted the defendant a limited extension to commence the SCC arbitration.
The court discusses the conditions for granting adjournment of a proceeding relating to the recognition and enforcement of an arbitral award, and the court’s discretionary power to do so, as well the determination of “suitable security” and the power to request it.
