The Magistrate Court refused to stay proceedings and refer the dispute to arbitration. The defendant in the court action was not a party to the contract containing the arbitration clause. It was irrelevant that the agreement was between the party which had filed the action and a US company which the applicant allegedly partially owned and which he managed – an allegation which was furthermore unproven.
