The High Court denied recognition and enforcement of an ICC award rendered in Singapore in a dispute concerning a border security system in Oman. The Court held that inadequate disclosure by the Singaporean sole arbitrator raised legitimate apprehensions about perceived bias, and enforcement would violate “basic notions of justice and morality”. The arbitrator had earlier acted as a co-arbitrator in a matter involving the chairman and promoter of MSA Global, and had not disclosed this prior association.
