The Queen’s Division Bench of the High Court of Justice, Business and Property Courts of England and Wales renders its decision in PAO Tatneft (Respondent) v. Ukraine (Applicant)

On 23 November 2020, the Queen’s Division Bench rendered its decision in PAO Tatneft v. Ukraine affirming that the failure to raise a jurisdictional objection during the course of the arbitration operates as a waiver to object to the arbitral tribunal’s jurisdiction on that point during enforcement proceedings.
